Welcome to the Recover Compensate Network, the home for anyone who has been referred by another firm of solicitors to Digby Brown regarding a personal injury matter. Law firms across Scotland have been corresponding with each other and referring clients for many years to give clients access to specialist legal services that are not core to their own practices. Digby Brown actively works with hundreds of other law firms across Scotland and beyond who recognise our expertise in the complicated area of personal injury litigation.

What is the Recover Network?

Our network has been formally operating since 2010, helping thousands of clients who initially approached their trusted, local solicitor firm for advice – and that advice was to benefit from referring the case to Digby Brown.

Early in 2023 we renamed the network to the Recover Network (previously the Compensate Personal Injury Network) and at the same time evolved and enhanced how we work with referred cases to meet the needs of our members.

Recover was designed to meet the changing landscape of the legal sector since the pandemic with a new management structure to prioritise case communication for referred client claims. We work in partnership with solicitor firms for all ongoing matters so each member is kept up to date and remains the trusted legal adviser of their client. Your permission will be sought for us to do that.

Our core guarantee is to ensure all referred clients receive the best service and outcome towards their case.

Why your solicitor is with Recover?

From our experience, clients at non-personal injury specialist firms do not always receive the best outcome when making a compensation claim due to the difficulty (and risk) of litigating this type of case. We know this is not because they couldn’t do the necessary legal work – they likely could – but they are simply not set up to do it. Similarly, we totally accept that Digby Brown would not be the best place to do the conveyancing when you sell your house or draft a rental agreement to let a shop. As solicitors, we all specialise and try not to dabble in legal areas in which we are not experts and when it matters to you, we know you want the best possible legal support – not merely a “that’ll do” service.

The most important factor in securing the best outcome is sorting out how the case is funded. Without proper funding in place, who is going to pay for the solicitor’s time as well as the (many!) costs involved to substantiate the case?

Digby Brown has this funding. You’ll have heard of “No Win No Fee”… this is simply where we defer all the time and costs incurred to the end of the proceedings and insure the risk if the case was unsuccessful. This means there are no costs to pay if the case is unsuccessful - and if it is successful then an agreed percentage of the damages is paid to the solicitor for the work they have done for you.

This is why referring firms know this is the best way to help you with your personal injury claim.

No win no fee personal injury solicitors

The expression “No Win – No Fee” is often used in personal injury cases.  It is used as a way of funding a compensation claim where the accident victim does not have the means to pay for the costs involved as the case progresses. 

A number of solicitors are prepared to handle personal injury cases on a “No Win – No Fee” basis but very few are able to offer their clients complete protection if the case is unsuccessful. 

In that event, the client could end up being liable for many thousands of pounds in legal expenses or the case won't be fully investigated and therefore likely to under-settle.

Compensate 'no win no fee' funding

Digby Brown has its own funding company, Compensate, which provides the funding to allow the case to be fully investigated, employ the best experts surrounding the circumstances of the accident and/or injuries sustained and where and if necessary go to court.

If for whatever reason the case is unsuccessful, Compensate pays all your legal expenses and those of your opponent – you pay nothing

Because of Compensate funding Digby Brown's success rate is extremely high and on average our clients receive three times the pre-litigation offer.

In the event the case is successful, a small percentage of your damages will be deducted with VAT to pay for this service. The percentage which Compensate will charge depends on the degree of risk involved. We believe that this is the fairest method of giving clients access to justice whilst ensuring their cases are fully investigated, prepared and funded.

Beware of compensation offers which may be too good

We know you will have seen many adverts offering 100% compensation or telling you that you will not lose any of your compensation, however we believe there are a number of problems with companies that do this.

  • How do they make their money if they don’t charge you anything?
  • If they aren’t taking any money from you, the client, what incentive do they have to ensure you receive the right level of compensation, appropriate to the injuries you have sustained?
  • Fully preparing a case, finding out exactly what happened and what the consequences of your injuries may mean in the long term, is expensive, how do they do this properly?
  • If they aren’t fully preparing these cases will they just accept the first offer they are given on your behalf by the Insurance company?
  • It makes simple business sense, the less work they do the higher their profit margin is - they simply have no incentive to work harder on your behalf.
  • These adverts in the main are from English firms on national television which operates in a different way and therefore wouldn’t apply to a Scottish person.

We know from the many client cases we mandate from other firms of solicitors (in the main at the request of the client who is extremely unsatisfied with the service received for the other firm) that many shortcuts are taken in preparation and that the first offer received is being recommended for acceptance, regardless of the value. 

Getting something for nothing is usually the first sign of poor service.

Our experience and statistics show time and time again we will achieve the correct level of compensation which will be substantially more than the insurer is initially prepared to offer.

Even after we have deducted our percentage as a success fee you will gain considerably more than you would have achieved using a 100% compensation model.

What does it mean for your case?

Once we speak to you to learn what has happened, and we believe that you have a case against a negligent party (those that caused the accident), we'll advise you and your referring solicitor where we think we can help. We will at that point talk you through the specific paperwork about funding the case and assign you to a solicitor who is best placed to help. Generally, your Digby Brown solicitor will be in the office which is close to you however we do have a number of specialist departments which might give a reason why we would advise you that the nature of the incident is best served by a specific team in a specific office. For example, our Serious Injuries solicitors are based in Glasgow but they travel all over Scotland to wherever their clients need them.

Your referring solicitor will be kept up to date on the progress of your case, so if you require additional support, you can speak with them at any time. These updates will, as already mentioned, only happen with your permission and will only relate to the legal milestones of the case – nothing specific or personal.
