Two families seek the truth after daughters injured in rollercoaster derailment

Digby Brown can confirm a legal action is underway after two young girls were injured when a rollercoaster derailed.  

It was previously reported that a “mechanical fault” caused the Runaway Timber Train to lose its wheels at Landmark Forest Adventure Park near Aviemore.

The carriages toppled down the track before coming to a halt at the bottom where it dangled off the edge of the track. 

Two 12-year-old girls suffered neck injuries and continue to suffer psychological trauma.

The health and safety investigations of the August 2021 incident have never been made confirmed so the families hope a legal action will help reveal what happened, get the girls the support they deserve and help make other parks safer. 

Mairi Day, Partner in our Edinburgh office, said: “People expect to be thrilled at theme parks but they should never expect to actually be harmed. 

“Parks and attractions are legally required to risk assess and maintain attractions and while safety regulations are strict, they are also very simple, so if all work is done as it should be then there’s no reason for these kinds of incidents to take place.

“But with Runaway Timber Train the available evidence shows there were gaps in the safety process which resulted in the injury of these two young girls and it is only right that those responsible are held to account.”

The legal actions for the two families were reported in STV, The Scottish Sun and Inverness Courier.
