Woman crushed by Land Rover gets £125,000 - after insurers tried to “fob her off” with just £5k

Rosie Don was not the kind of person who ever thought of making a personal injury claim.
But after her whole life changed because of an accident that wasn’t her fault, she knew she needed help.
Rosie, 57, was walking across the forecourt of the Tesco Extra petrol station on the Kingsway in Dundee when a Land Rover driver failed to see her and drove over her left foot.
She suffered multiple bone breaks which stopped her working and in the end, she was made redundant.
Not long after the crash the insurance company for the Land Rover offered Rosie just £5,000 for her injured foot.
But this sum was offered despite no one at the insurer reviewing any medical evidence or assessing the extent (and cost) of the long-term impact of her injuries.
The insurer certainly didn’t consider how the injury impacted her ability to work and its link to her losing wages – a sum that was bound to be WAY more than just £5k.
Rosie said: “I used to think injury claims were one of those grubby affairs but now I know that’s entirely not true.
“It isn’t until are you are injured yourself that you realise you need help.
“I remember saying when the first offer came in ‘They have a brass neck to offer me that’ because it didn’t even cover my wages for six weeks.
“It was like the insurer was trying to take advantage of the urgency of my situation.
“My niece encouraged me to get a solicitor and I’m so glad she did because only after speaking to Digby Brown I was assured that what was happening to me wasn’t fair.”
Rosie was put in touch with Euan Robertson from our Dundee office.
He gathered the medical evidence that showed the extent of Rosie’s physical injuries and how it impacted her life now and in the future.
Euan then took extra steps to help his client – like helping her access physiotherapy to alleviate pain and aid mobility, as well as CBT therapy to help her adjust to a new way of life and resolve the mental trauma of the collision.
But most importantly – he could recover a £10k interim payment to help her cover immediate costs until her case concluded.
And when it finished it settled for the sum of £115,000 – bringing the total amount to £125k.
This was 25 times more than the insurer’s first offer.
Rosie added: “Euan was absolutely brilliant, I felt so looked after and I was blown away by his empathy.
“I knew he would do everything possible to help my foot and ankle get better. If I called and went into a rant he would always listen and be sympathetic.
“Having him at the end of the phone helped me through one of the worst experiences in my life.
“With the insurers I felt like I was being fobbed off but with Euan I felt like he cared.
“Now that everything is done I’m now looking forward to putting it behind me and moving on with my life.”
